Group Travel Terms & Conditions:

 

Riviera Maya Eco Tax - Municipality of Solidaridad

The Municipality of Solidaridad will be charging an Eco Tax of 20.00 Mexico Pesos (approx. $1.10 USD) per room per night. This amount is not included in your vacation price and will be collected at your hotel. These funds are being used to protect, maintain and conserve the natural beauty of the destination the area and its surroundings.

Cancun and Puerto Morelos Environmental Sanitation Tax – Municipality of Benito Juarez

The Municipal Government of Benito Juarez will be charging all guests in the area of Cancun and Puerto Morelos an Environmental Sanitation Tax of a minimum 30.00 Mexican Pesos (approx. $1.60 USD) per room per night. This amount is not included in your vacation price and will be collected at your hotel. These funds are being used to protect, maintain and conserve the extraordinary beauty of the area.

Hazardous Materials Notification

In instances where a single person is acting on behalf of a group of passengers in relation to the ticket purchase and check-in processes, that single person is assuming the responsibility of providing hazardous materials restrictions to each passenger traveling, and is responsible for providing the indication of understanding on behalf of the group. Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person.   1. To qualify for a group rate:

A group must maintain the minimum required amount of rooms/room nights and passengers based on the chosen hotel in order to maintain the group rates. If the group falls below the minimum, the group may be canceled and individuals transferred to general reservations and charged the current rate. Group passengers may not deviate from inclusions, options, and/or features provided to the group.

  1. Name changes:

Name changes provided in writing will be accepted until day of departure, but are subject to the provisions of hotel/suppliers contracts. Name changes can be refused at any time or subject to cancelation penalties in the case of a hotel/supplier close-out**. Name changes requested after documents are issued will be assessed a $50.00 per person name change fee.

**All groups are subject to hotel/supplier close-outs. In these circumstances, group names may be required immediately to avoid the loss of rooms or availability. Name changes for hotel inclusive groups are not allowed at airport or at hotel check in.

  1. Flight Times:

Charter flight times are subject to change.

  1. Relationship of Parties:

The parties are independent contractors. Each party assumes full responsibility for the acts and omissions of its employees and agents and, except as otherwise provided herein or agreed in writing, neither party has the authority to make commitments, enter into contracts on behalf of, bind, or otherwise obligate the other in any manner whatsoever.

  1. Confidentiality:

Each party agrees that, except with the prior written permission of the other party, it shall keep confidential, and not divulge, furnish or make accessible to any third party, any confidential information or data concerning or relating to the group.

  1. Jurisdiction:

This Fair Trade Contract shall be governed by the laws of the Commonwealth of Pennsylvania. Should a dispute or controversy arise concerning the terms and conditions of this Fair Trade Contract or involving a claim for loss, injury or other damage arising out of or relating to your trip, any legal action against Funjet Vacations shall be brought exclusively in the Pennsylvania Court of Common Pleas of Delaware County. If any term or provision of this Fair Trade Contract is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, such holding will not affect the validity or enforceability of the remaining terms and provisions.

  1. Compliance with Laws:

Each party shall, at its own expense, comply with all applicable laws and regulations as may be necessary for such party's performance under this Agreement.

  1. No Consequential Damages:

In no event shall either party be liable for any indirect, special, incidental or consequential damages. Beach Happy Travel and/or Funjet Vacations shall further not be liable for the actions or omissions of any third party.

 

 

  1. Attorney's Fees and Costs:

If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorney's fees, costs, and necessary disbursements in addition to any other relief to which it may be entitled including but not limited to interest on unpaid balances at the maximum amount permitted by law.

  1. Force Majeure:

Beach Happy Travel and/or Funjet Vacations shall have no responsibility or liability to any part for the following (collectively "Force Majeure Events"): any loss, cost, or damage incurred by either party arising from or in connection with the failure to perform any obligation under this contract provided such failure results from an act of God, seizure under local process, sanctions, quarantine restrictions, fire, fog, volcanic ash, smog, earthquake, flood, weather, hurricane, mechanical difficulties, riots or civil commotions, strikes, labor stoppage (whether resulting from disputes between either party and its employees, or between other parties), war, acts of terrorism, travel service provider disruption or delays, flight cancelations or delays, and any other acts, matter of things, whether or not of a similar nature.
